The following are the terms and conditions applicable to the Three Ireland (Hutchison) Limited (”Three”) trade-in offer (“the Offer”) and are in addition to the terms and conditions of service and form part of the general customer terms and conditions of the Three service that relate to the use of Three mobile telecommunications services.
Subject to these terms, the Offer is available to (a) Bill Pay consumers trading in an iphone 4 16GB or 32GB, iphone 4S16GB or 32GB or Samsung S II or SIII handset who are porting in to the Three network from another Irish licensed telecommunications operator or upgrading on the Three network (“Eligible Bill Pay customers”).
The Offer is only available to Eligible Bill Pay customers signing up to a 24 month Classic Flex Max plan with an iPhone 5 16GB or Samsung Galaxy S IIII or a Sony Xperia Z or HTC One. Or customers signing up to a 24 month Ultimate Flex Max plan with an iPhone 5 16GB.
The offer ends on 30th September 2013.
Each handset traded in must meet the following conditions:
The handset must turn on and off and it must be capable of making a call
The handset must be fully functional
The screen must be working and intact
The battery must be included
The handset must not be cracked or water damaged
The handset must not be stolen or listed with Three or any authority as being stolen
The handset must be original and meet the manufacturer’s original specifications.
The handset must have been purchased in Ireland and have Irish specifications.
This Offer is open to both new and existing Three customers
Three accepts no liability in the event that any handset which has been sent with a SIM Card therein incurs charges.
Any SIM cards received by us will be destroyed.
You agree to indemnify us from all and any claims, losses or damages with respect to the handset, any SIM Card, any data stored or contained therein or on any media used in conjunction with the handset.
We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the handset prior to providing it to us.
In the event that Three becomes aware of any issue with your handset at any time, we reserve the right to withhold or cancel payment and you agree to co-operate with 3 and any authorities should we so request.
You acknowledge that should you wish to avail of our 14 day returns policy, your traded in handset will be returned to you. Three will keep your traded in device for 28 days after receipt only. Under no circumstances will you receive a cash payment for the handset traded in if availing of the 14 day return or if you are permitted to terminate outside of the 28 days after the trade in device is received by Three.
We accept no responsibility for any termination or cancellation fees which may be incurred by you in trading in your handset.
Any handsets meeting the requirements set out in these Terms and Conditions will entitle the owner to a new handset at the relevant cost, if applicable, subject to these terms. Only one trade-in is accepted per connection and the trade-in offer cannot be used in conjunction with any other offer.
Three will not enter into any correspondence with you in relation to trade in values.
We reserve the right to withdraw, modify or alter these terms or the trade-in offer at any time without notice and to reclaim any discount given to you if we suspect that any information provided by you is incorrect or if we suspect that the traded-in handset has been stolen.
Trade in credit cannot be redeemed against any other Three product or service or any deposit requested
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
