3mail Terms & Conditions.

You need to read and accept the following terms and conditions in order to use this service.

Terms and Conditions.

1. 3mail Service is made available to you by Hutchison 3G Ireland Limited having its registered office at 3rd Floor, 6 – 10 Suffolk Street, Dublin 2 ("3") on the condition that you accept, without amendment, these terms and conditions (the "Terms") below. By subscribing to and using the 3mail Service you consent to the Terms. Please read the Terms carefully as it sets out your rights and obligations with respect to the use of the 3mail Service.
2. 3 reserves the right to modify the Terms at any time and at its sole discretion and without notice to you. It is your responsibility to regularly review the Terms for modifications. By continuing to use the 3mail Service, you agree to be bound by the amended Terms.

3mail Service.

1. The 3mail Service comprises a personal account that enables you access the Microsoft Windows Live service: (i) to register an email address comprising an unallocated username chosen by you with the "@3mail.ie" domain ("Domain") together with 5GB e-mail storage ("Email Service"); (ii) 25 GB virtual hard-drive; and, (iii) facilities to create a personal webspace/blogs, calendar and contacts, collectively, the "Service".

Provision of the Service.

1. The Service is provided by Microsoft Corporation ("Microsoft"). 3 provides to you (i) the limited right to use the the Domain in conjunction with your user name and (ii) the means to access to the Service, provided by Microsoft, via the 3 Ireland website located at www.three.ie, subject to these Terms.
2. You agree that in order to access and use the Services you will also be required to accept and comply with the Microsoft terms of service ("Microsoft Terms").
3. The Service is available to active customers of 3's mobile telephony and broadband services. 3 reserves the right to disconnect you from the Service if you cease to be an active customer of these services.
4. You agree that 3 may establish, and update from time to time, limits on the use of the Services, including but not limited to the period that emails or user content will be retained on the Service, the number of emails that may be sent from or received, the maximum size of an email message that may be sent from or received by an account, the maximum storage space available to an account and the maximum number of times and duration you can access the Services in any period of time.
5. You agree that 3 has no liability for the deletion of or failure to store any emails, or other content and you acknowledge that 3 has the right to remove accounts that are inactive for an extended period of time.

User Account, Password, And Security.

1. You are responsible for maintaining the confidentiality of your password and account information, and for any and all activities which occur under your account and use of the Services. You agree to immediately notify 3 on 1913 of any unauthorised use of your account, password, or any other breach of security known to you. 3 will not be liable for any loss that you may incur as a result of someone else using or accessing the your password or account, either with or without your knowledge. However, you may be held liable for losses incurred by 3 or any other party as a result of someone else using or accessing your password or account. You will not use anyone else's account at any time without the permission of the account holder. You may change your password by contacting us at 1913.

Personal Information.

1. 3 shall use personal data provided by you (i) as part of your registration for access to the Services; and (ii) any information collected by 3 in relation to your access to the Services, in accordance with applicable Irish data protection legislation and law.
2. You agree that to the extent that you are required to provide to 3 personal data in order to register for access the Services you agree to:
   (a) provide true, current, complete and accurate information about yourself as prompted to do so; and
   (b) maintain and promptly update this information as required to keep it true, current, complete and accurate.
   (c) If you provide any information, or 3 has reasonable grounds to believe that any information provided by you, is not true, current, or complete or is not accurate, 3 may suspend or prevent your access to the Services.
   (d) 3 will retain the information provided by you as part of your registration for the Services and records of your access to the Services for (i) as long as is necessary to provide access to the Services to you; (ii) and in order to comply with law.
3. If you have agreed that 3 may contact you on the email address provided to you, at the time of your registration, 3 may email you with information relating to its products and services (including those it provides in cooperation with its value added services partners) until you notify us that you no longer wish to be contacted on this by unsubscribing using the unsubscribe facility provided on the email received by you or by contacing us by calling 1913.
4. 3 reserves the right to disclose the the information you provided at the time of your registration (inlcuding any revisions to this information) and details of your access to the Servcies as required by law or we have reasonable grounds to believe that such dislosure is necessary to protect 3, it business, property and IT systems; to enforce these Terms; to respond to any complaint received regarding the rights of third parties; and to protect the rights of any third party.

Your obligations.

1. By using the Services you warrant that you are eighteen (18) years or over or you are using the Service under the supervision and with the authority of your parent or guardian.
2. You agree to not use or attempt to use the Services to:
   (a) upload, post or otherwise transmit any content that is unlawful, harmful, abusive, harassing, vulgar, defamatory, invasive of another's privacy, racially, ethnically or otherwise objectionable;
   (b) harmful to minors;
   (c) impersonate others or to disuise your identity or the origin, time or contents of any content or communications transmitted or available via the Service;
   (d) upload, post or otherwise transmit any content in breach of any duty of confidence;
   (e) upload, post or otherwise transmit content that infringes any intellectual property right of any person (including without limitation any patent, trade mark, trade secret, copyright or database right);
   (f) upload, post or otherwise transmit any unsolicited or unauthorised advertising, promotional materials;
   (g) collect or use personal data about other users without their consent;
   (h) interfere with or disrupt the Services or any IT systems connected to the Services;
   (i) breach any policies or regulations of networks connected to the Services;
   (j) breach any applicable laws or regulations;
   (k) upload, or transmit any material (including without limitation any software, virus or other programe) that contains anything designed or capable of adversely affecting (i) any software, or IT or communicaitons system (ii) of the normal use by any of the Service;
3. You agree to indemnify and hold harmless, 3, its group companies, officers and employees, from any claim or demand, including reasonable legal expenses made or brought by any third party due to or arising out of:
   (a) your use of the Services or any part or them;
   (b) the violation of these Terms or any provision by you;
   (c) the infringement or misappropriation by you, or a third party using your computer, of any account or password to access and/or use the Services;
   (d) the infringement or misappropriation by you, or a third party using your computer, of any intellectual property rights of any person or entity;
   (e) the use or misuse by you or third parties of your passwords or accounts;
4. You understand that by using the Services, you may be exposed to material and communication that is offensive, indecent or objectionable and you acknowedge and agree that 3 is not responsible or liable for such material.

Proprietary Rights.

1. You agree that the materials that you may have access to through your use of the Services may be the intellectual property (including without limitation trade mark, trade secret, copyright or database right of third parties) (including 3) and is legally protected.
2. You agree that 3 (or its group companies) owns "@3mail.ie" domain and your entitlement to use this for the purpose of accessing and using the Services is on the basis of a limited, revocable licence and subject to your compliance these Terms.
3. You are only granted a limited personal licence for your own personal, non-commercial use of the Services. All copyright and other proprietary notices in the third party materials must not be altered. Except to the extent permitted by law, you may not copy, reproduce, distribute, or create derivative works from any material without expressly being authorized to do so by the relevant owner.
4. If you infringe any person's intellectual property rights breach of these Terms, your right to use the Services shall cease.
5. You are entirely responsible for all materials that you upload, post or otherwise transmit via the Services. 3 does not control any materials trasnmitted via the Services and does not guarantee the accuracy, integrity or quality of such material. You agree that in posting any material in any public area of the Services you grant to 3 a royalty-free, perpetual, irrevocable, non-exclusive and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or in part) worldwide and/or to incorporate it into any other works in any form, media.

Modifications and Discontinuance Of The Services.

1. 3 reserves the right at its sole discretion to modify or discontinue the Services, without notice to you. 3 shall not be liable to you or any third party should 3 exercise its right to modify or discontinue the Services.

Suspension and Termination.

1. 3 reserves the right:
   (a) to suspend or terminate all or part of the Services at any time without notice, if you are in breach of the Terms, or if we are instructed to do so by any competent authority. 3 will not be liable to you or any third party for any loss or damage howsoever arising from the suspension or termination of the Services or any part of them;
   (b) and without prejudice to the the preceding paragraph, to suspend and terminate any account which it believes is transmitting or is otherwise connected with any unsolicited bulk e-mail;
   (c) to terminate your access to the Service if you cease to use 3’s mobile telephony, broadband or other paid for service;
   (d) to suspend and permanently deactivate a user’s account following 12 months inactivity and to delete all information contained on the user account; and.
   (e) In the event of termination of your account for any reason whatsoever there is no obligation on 3 to forward any unread or unsent messages to you or a third party.

Services Provided By Third Parties.

1. The Services may contain advertisements (banner ads, paid links, pop-up windows), images to and links to third party products services and websites ("Third Party Sites"). Third Party Sites and the contents of any advertisements or any third party sites accessed using any links are not under the control of 3, nor does their inclusion imply any endorsement of such third parties and you agree that 3 is not responsible for the inclusion of the advertisements on the Services or the content of any Third Party . You agree that 3 is not responsible or liable for any loss or damage of any sort incurred as result of the presence of such Third Party Sites on the Services.

No Warranties.

1. The Services is provided "as is" and "as available" basis, and you use the Services at your sole risk.
2. 3 is not responsible for the introdcution of any virus into any of the Services.
3. 3 does not make any warranty or representation that Services will meet your requirements; that it will be uninterrupted, timely, secure, error free or that any material or content accessed using the Servcies is lawful, accurate or reliable;
4. To the extent permissible by law, 3 disclaims all warranties (express, implied or statutory) of any kind insofar (including, but not limited to, the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement).
5. You agree that any material communicated to you via the Services is accessed by you at your own risk. 3 is not responsible for any damage or loss to your IT systems, computer or data resulting from you accessing such material or use of the Services.
6. 3 has no liability to you for any goods or services you may purchase using the Services;
7. If you use the Service for business purposes, 3 accepts no responsibility for deletion, corruption or failure to store messages or content maintained or transmitted by the Service and accepts no responsibility and is not liable for any interruption of business as a direct or indirect result of Services.

Limitation Of Liability.

1. 3 is not be liable to you whether by breach of contract, tort (including but not limited to negligence) or statutory duty for any loss of use, interruption of business, loss of profit, loss of business, loss of data or any financial or economic loss, or any direct or indirect, special, incidental or consequential damages of any kind even if 3 has been advised of the possibility of such damages, howsoever arising, out of use of the Services.

Law.

1. These Terms shall be governed by and interpreted in accordance with the laws of Ireland and the user and 3 agree to submit to the exclusive jurisdiction of the courts of Ireland.

Miscellaneous.

1. You may not assign or trasnfer your rights or obligations under this Agreement except with 3's the prior consent. 3 is entitled to assign this Agreement.
2. If any of the Terms are not valid or legally enforceable, the other terms will not be affected. We may replace any item that is not legally effective with a similar term that is.
3. If we, delay, or do not take action to enforce our rights under these Terms, this does not stop you, or us, from taking action later.

Notice.

If 3 needs to send any notices under these Terms to you, it may do so will do through the Services and this shall constitute notice to you. 3 may also communicate to you using your account information for any other 3 service (including billing address telephone number(s) (if any)) via advertisement in national press and on three.ie/customernotification.
